Respondents Prayer: Writ Petition is filed to issue a Writ of Declaration, declaring that Section 17(2)(vi) of the Income Tax Act, 1961, and Rule 3(7)(i) of the Income Tax Rules, 1962, and consequently, Para 5 read with Sub-Para 3 in Annexure II to the Circular dated 11.11.2014 (H.O.Circular No.803/2014) bearing No.19.00/20/2014 issued by the 4th respondent are unconstitutional, ultra vires the Income Tax Act, and therefore null and void.
