2. Heard the learned counsel for the parties and perused the materials available on record.

The challenge is primarily on the ground that the petitioner did not possess the requisite qualification to be appointed as Municipal Commissioner Grade II, since he did not possess the degree and the post graduate degree obtained by the petitioner was not under the 10 + 2 + 3 pattern of education and therefore, is stated to be not valid and not Page Nos.3/6
recognised.

The petitioner filed a writ petition in W.P.No.32972 of 2025 challenging the Letter No.11770/M.E.1/2011-9 dated 13.06.2022, where it was stated that that the appointment of two individuals namely, the private respondents therein including the private respondent herein have been revisited as per the orders of this Court dated 24.09.2020 in W.P.No.22058 of 2013 and that their appointment to the post of Municipal Commissioner Grade-II, was found to be in accordance with the requirements prescribed under the Special Rules for the Tamil Nadu Municipal Commissioner Subordinate Rules.

The Writ Court, vide order dated 29.08.2025, set side the said letter and directed the Secretary to the Government, Municipal Administration and Water Supply Department, Secretariat, Chennai, to consider the matter afresh and pass orders, after issuing notice to the petitioner therein and also to the interested parties, and after affording them an opportunity of hearing.
6. Now, that the matter stands remitted to the first respondent to determine as to whether the private respondent possessed the requisite qualification to be appointed to the post of Municipal Commissioner Grade Page Nos.4/6

7. Inasmuch as the issue regarding the entitlement of the private respondent to promotion to the said post is presently seized of by the first respondent, nothing survives for adjudication before this Court
8. With the above observations, the captioned Writ Petitions stand disposed of. It is open to the parties to agitate their respective contentions before the first respondent. Consequently, the connected miscellaneous petitions are closed.
