ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 379 of I.P.C. and 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.267 of 2021, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had transported one unit of river sand without obtaining proper license. Hence, the complaint.

3. It is seen from records that this is the second anticipatory bail petition filed by the petitioner. Earlier anticipatory bail application was dismissed by this Court on 15.07.2021 in Crl.O.P.No.12205 of 2021.

4. The learned Government Advocate (Crl. side) submitted that there is no change in circumstances after the previous order was passed on merits. Hence, the learned Government Advocate vehemently opposed to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

In view of the submission made by the learned Government Advocate, no change of circumstances arises for considering the second anticipatory bail petition. Hence, this Criminal Original petition is dismissed.
