ORDER

This petition has been filed to set aside the judgment made in Crl.M.P.No.1213 of 2016 dated 29.08.2016 on the file of the Principal Sessions Judge, Puducherry.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. It is seen that the petitioner herein was granted bail by the Judicial Magistrate-I, Puducherry in Crl.M.P.No.2310 of 2016 in Cr.No.136 of 2016 on 03.08.2016, challenging which the State has filed an application for cancellation of https://hcservices.ecourts.gov.in/hcservices/

bail u/s 439 Cr.P.C. before the Principal Sessions Judge and the Principal Sessions Judge, Puducherry, by order dated 29.08.2016 in Crl.M.P.No.1213 of 2016 cancelled the bail that was granted to the petitioner herein. Challenging the order passed by the Principal Sessions Judge, Puducherry, this criminal revision petition is filed.

4. In the considered opinion of this Court, an order cancelling the bail is an interlocutory order and is not a final order and therefore, the criminal revision petition is not maintainable. This has been lucidly explained in an unreported judgment of this Court dated 28.04.2015, in Crl.R.C.(MD).No.189 of 2015 [Ponraj v. Sub Inspector of Police, Melappalayam Police Station, Tirunelveli District.] In view of the above, this petition is dismissed. Consequently, connected miscellaneous petition is closed.
