ORDER
(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 21.06.2020 for the offences punishable under Section 302, 120B IPC and 27(1) of the Arms Act, in Crime No.956 of 2020 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner conspired with the paramour and committed the murder of her husband. 3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and she has been falsely implicated in this case based on the confession of the co-accused. He would further submit that the petitioner was arrested on 21.06.2020 4.Per Contra, learned Government Advocate (Crl. Side) would submit that the petitioner was having illicit intimacy with one Kuppusamy and that on 09.06.2020 while her husband was coming back in a two wheeler, A1 had shot him in a country made gun, due to which, he sustained injuries and fell down. He would further submit that the petitioner admitted her husband in the hospital and had given a false information stating that her husband fell down in an inebriated condition and sustained injuries. came to light that the victim had suffered bullet injuries. The petitioner was initially admitted in Thirupattur Government Hospital, thereafter, he was shifted to Salem Government Hospital and died. The petitioner had diverted the attention of the respondent police by giving a false information stating that her husband fell down and died due to the injuries sustained by him. He would further submit that the investigation is in initial stage.
5.In view of the above submission so made by the learned counsel, this court is not inclined to grant bail to the petitioner. 6.This Criminal Original Petition stand dismissed accordingly. -sd/- 13/08/2020 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
