Civil Suit is filed under Order IV Rule 1 of the Original Side Rules read with Order VII Rule 1 of the Civil Procedure Code, prays (a) declaring the plaintiff title in respect of the suit schedule mentioned properties to an extent of 2/3rd disputed share, (b) for a consequential permanent injunction restraining the defendants, their men, agents servants or representatives from in any manner interfering with the plaintiff's peaceful possession and enjoyment of the suit schedule mentioned properties and for costs.

JUDGMENT

Today, when the matter came up for hearing, the learned counsel for the plaintiff and the defendants submitted that the matter has been settled between the parties by way of Memorandum of Compromise dated 25.03.2024, which has been duly signed by the parties and their respective Counsel. The said Memorandum of Compromise is recorded.

2. In view of the above, the suit is decreed in terms of the Memorandum of Compromise dated 25.03.2024 entered between the parties and the above Memorandum of Compromise shall form part of the decree. The Court Fee is ordered to be refunded in accordance with law. Index:Yes:No Speaking order : Yes:No MSM Note: Registry is directed to return the original sale deed dated 27.07.1973 after retaining a xerox copy of the sale deed.
