ORDER

This writ petition has been filed seeking for survey and demarcation of boundaries of the properties more fully described in the prayer to this writ petition.

2.Since the petitioner's representation dated 10.02.2025 seeking for survey and demarcation of boundaries has not been considered by the official respondents, the petitioner has filed this writ petition. 3.A counter has been filed by the official respondents. According to them, only due to non-cooperation of the petitioner, the representation of the petitioner dated 10.02.2025 seeking for survey and demarcation of boundaries could not be completed by the Tahsildar. However, the said contention is disputed by the learned counsel for the petitioner. 4.Learned counsel for the petitioner, on instructions, would submit that the petitioner is now willing to cooperate in the survey and demarcation of boundaries. No prejudice would be caused to the respondents if the survey and demarcation of boundaries is done after 3/8

hearing the objections of the private respondents, viz., R8 to R10 and any other third party whom the 3rd respondent deems it fit to put on notice. 5.Since no adverse orders are passed against the private respondents, viz., R8 to R10 in this writ petition, notice to R8 to R10 is dispensed with by this Court.

6.Necessarily, the petitioner will have to cooperate in the survey and demarcation of boundaries by the third respondent. 7.All the supporting documents produced by the petitioner as well as the private respondents 8 to 10 shall be considered by the 3rd respondent while surveying and demarcating the boundaries of the property more fully described in the prayer to this writ petition. 8.For the foregoing reasons, this writ petition is disposed of by directing the 3rd respondent with the assistance of a Surveyor to survey and demarcate the boundaries of the property more fully described in the prayer to this writ petition based on the petitioner's representation dated 10.02.2025 after hearing the objections of the private respondents, viz., R8 to R10 as well as any other third party whom the 3rd respondent deems 4/8

it fit to put on notice within a period of 12 weeks from the date of receipt of a copy of this order. Consequently, connected miscellaneous petition is closed. No costs.
