O R D E R

This criminal revision has been filed seeking to set aside the order dated 20.03.2024 passed by the learned II Metropolitan Magistrate, Egmore, Chennai, in Crl.M.P.No.11509 of 2024.

2. The learned counsel appearing for the petitioner submitted that the petitioner's daughter had written Railway Recruitment Board Exams on several times and in spite of her best efforts, she could not get the job. At that time, the petitioner approached one Saminathan regarding the job for his daughter in the Railways and for which, the said Saminathan introduced the petitioner / complainant to one Micheal and Thayalani Devi who are working in the Railways Recruitment Board Office. They told the petitioner that if the petitioner pays a sum of Rs.12 Lakhs, they will get the job under the Minster Quota. Regarding the same, the petitioner has deposited a sum

of Rs.12 Lakhs to the accused persons. In spite of several requests and demands made by the petitioner, the accused persons neither secured the job nor returned the amount paid by him. Hence, the petitioner has filed a private complaint under Section 156(3) of Cr.P.C. before the learned II Metropolitan Magistrate, Egmore, Chennai to register FIR against the accused persons. However the said petition was dismissed. Challenging the same, the present revision has been filed by the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondents submitted that during the pendency of the case, the matter was enquired and the case was registered against the accused persons in Crime No.145 of 2024 under Sections 406, 420, 465 and 471 of IPC and he has produced a copy of the same before this Court and hence nothing survives for adjudication in this revision.

4. In view of the above submission made by the learned

Government Advocate, as the Law Enforcing Agency has registered a case against the accused persons in Crime No.145 of 2024 under Sections 406, 420, 465 and 471 of IPC, this Court is of the view that, nothing survives for further adjudication in this revision.
