This petition has been filed seeking to condone the delay of 2,453 days in filing the Civil Miscellaneous Appeal.

2. The learned counsel for the petitioner submitted that since there has been a significant delay in filing the appeal, the petitioner has no objection to the interest not being granted for the said delayed period.

3. Mrs.R.Sreevidhya, learned counsel appearing for the second respondent, vehemently opposes the condonation of delay.

4. The reasons adduced in the affidavit filed in support of this petition being satisfactory, this Civil Miscellaneous Petition is ordered and consequently, the delay of 2,453 days in filing the appeal is condoned, subject to the condition that the claimant/petitioner will not be entitled to any interest for the delay period i.e., for 2,453 days, in the appeal.

5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order, and list the same for admission on 23.06.2026.
