Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the second respondent to comply the direction as per Letter bearing No.Na.Ka.1566/2021/A4 dated .09.2021 issued by the first respondent in respect of the encroachment of the third respondent.

ORDER

(Made by the Hon'ble Chief Justice) Heard Ms.J.Pavitra, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader for the respondents 1 and 2.

2. The petitioner claims encroachment on a public pathway. We do not find anything placed on record to substantiate the existence of a common pathway in the subject writ property.

3. In absence of the relevant documents, it will not be possible to pass orders. In case, the petitioner is in a position to lay hands on the records to substantiate about the existence of the pathway and encroachment thereupon, then the petitioner may file a fresh petition.

4. With these observations, the writ petition stands disposed of. There will be no order as to costs.
