This revision is preferred against the order of learned Judicial Magistrate, Tirukoilur, passed in Crl.M.P.No.297 of 2016 on 12.04.2016. By way of the order under challenge, a complaint of offence u/s. 499 I.P.C was dismissed.
2. The allegation in the private complaint is that the accused persons falsely contended that the Tirukoilur Bar Association has passed a resolution to the effect that no advocate shall appear on their behalf in the civil proceedings in O.S. No. 155/12 on the file of Principal District Munsif, Thirukovilur and thereby defamed the complainant advocate association. The librarian of the advocates association is a party in the said suit. Besides observing that any association or persons should not be overly sensitive, this Court would dismiss the revision also for the reason that neither the association rules or byelaws have been produced nor is the complaint supported by any resolution of the concerned https://hcservices.ecourts.gov.in/hcservices/
association permitting the complainant/alleged president to prefer the complaint.
