ORDER
The petitioners are summoned to executive bond under Section 107 of Cr.PC, against which, he has filed this petition in M.C.No.105/2021, by the Sub Divisional Magistrate/RDO Nagapattinam.
2.The contention of the petitioners is that the 3rd respondent is the son of the 1st petitioner who had been settled with a property and using the said property he had put up a petrol bunk and thereafter failed to take care of the petitioners. Hence, the 1st petitioner lodged a complaint before the 1st respondent under Senior Citizenship Act, against the 3rd respondent, seeking cancellation of the settlement deed and the same was ordered in favour of the 1st petitioner. Despite, the 3rd respondent preferred an appeal and the same was also dismissed.
3.The learned Government Advocate (Crl.Side) appearing for the respondent police submits that there are several disputes between the petitioners and the 3rd respondent. It is not in dispute that the petitioners 1 and 3 are parents of the 3rd respondent and the 2nd petitioner is the brother and the 4th petitioner is the wife of the 2nd petitioner. All are close relatives. It is a family dispute between them. Due to the prevailing condition, good conduct and behaviour of the the petitioners, the 1st respondent by order dt.26.05.2021, directed petitioners to execute a bond and a surety for Rs.5000/- for a period of one year.
4.On instructions, the learned counsel for the petitioners submits that the petitioners shall appear before the respondent police and execute the bond and comply with the order dt.26.05.2021, on or before 05.07.2021 without fail. 5.This petition is disposed of with the above direction. Consequently, the connected miscellaneous petition is closed.
