Criminal Original Petition filed under Section 439 (1) (b) of the Code of Criminal Procedure,1973, to modify the order of the IV Metropolitan Magistrate, Saidapet, Chennai in Crl.M.P.No.2646 of 2019 dated 08.04.2019 in respect only to the condition "(i) the petitioner shall execute a bond for a sum of Rs.10,000/- with sureties to the like sum each. One of the surety must be his blood relative or his wife." to "the petitioner shall execute a bond for a sum of Rs.10,000/- with any two sureties to the like sum each".

ORDER

This petition has been filed seeking for modifying the condition imposed by the Court below directing the petitioner to produce two sureties for a like sum out of which one surety must be a blood relative or his wife.

2. The learned counsel for the petitioner submitted that there are no blood relatives for the petitioner and he lost his parents at an young age. The learned counsel further submitted that the petitioner has an adoptive father. To that effect, an affidavit was also filed before this Court. The affidavit is taken on record.

3. In view of the above, the first condition imposed by the Court below is modified to the effect that the petitioner shall execute a bond for a sum of Rs.10,000/- with two sureties for a like sum and one of the surety shall be the adoptive father of the petitioner. The other conditions imposed by the Court below shall stand as it is.

This Criminal Original Petition is disposed of accordingly.
