Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379 of IPC and Section 21(1) of Mines and Minerals (Development and Regulation) act, in Crime No.60 of 2022, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that based on the secret information on 05.02.2022, at mattaparai Village, the Village Administrative Officer found the lorry and JCB, while loading granite from the quarry without any license. Hence, the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is as A3 who is the owner of the vehicle involved in this and he is no way connected with the alleged offence and he has been falsely implicated in this case. Hence, he would pray for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.side) would raise strong objection stating that 6.5 tons of granite stones were illegally excavated from the quarry without any valid license. Hence, he vehemently opposed for grant of bail.
5.Considering the huge quantity of granite stone involved in this case, this court is not inclined to grant anticipatory bail to the petitioner.
