JUDGMENT

(Made by DR.VINEET KOTHARI, J.) The Court was held by Video Conference, as per the Resolution of the Full Court dated 3 July 2020, by Judges at their respective residence and the counsel, staff of the Court appearing from their respective residences.

2. Heard the learned counsel for the appellant Mr.P.Vijendran. The only limited relief claimed before us by the learned counsel for the appellant is that the appellant's water connection may be restored by the 4th respondent / landlord - Mr.Vasudevan, subject to the payment of arrears of rent by the appellant/tenant and subject to payment of regular rent by him.

Since the learned single Judge is seized of the writ petition, we consider it appropriate to grant a limited interim relief to the appellant to the effect that subject to payment of arrears of the rent by the appellant/tenant to the 4th respondent /landlord and continue to pay the regular rent as agreed between the parties, the water connection of the appellant may be restored by the 4th respondent/ State Authorities. Except that, rest of the contentions between the parties may be decided by the learned Single Judge in the pending writ petition.

4. With these observations, the writ appeal is disposed of. Since this order is passed without issuing notice to the respondents, we direct that copy of this order may be sent to the respondents as well as be placed on the record of the learned Single Judge. We further request the learned Single Judge to expedite the hearing of the writ petition.

5. With these observations, the writ appeal is disposed of. No costs. Consequently, connected miscellaneous petition in C.M.P.No.9599 of 2020 is also closed.
