This application has been filed seeking to condone the delay of 162 days in filing the written statement on behalf of the 1st & 2nd defendants. The suit has been filed seeking partition and separate possession. The plaintiff is the son of the 1st defendant. 2nd & 3rd defendants are the other sons of the 1st defendant. 3rd defendant, on whom the suit summon has been served has not chosen to appear before this Court. However, 1st & 2nd defendants have filed the application and an affidavit to explain the delay and stated that they were searching for some documents and that they had traced the same recently. This caused the delay in filing the written statement.
2. The learned counsel for the plaintiff is also present. Taking into consideration of the facts and circumstances of the case, this application to condone the delay of 162 days in filing the written statement stands condoned.
3. It is seen from the records that D3 has been served on 14.03.2024. D1 & D2 have filed their written statement consequent to the application https://www.mhc.tn.gov.in/judis
