Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 to 3 restraining the 4th respondent from establishing the "Marana Kinaru and Giant Wheel"Games at Kuttaithidal Premises at Udumalpet, Thiruppur District without getting proper permission from the 1st respondent by considering the representation of the petitioner herein dated 13.04.2019. O R D E R

The petitioner seeking for Mandamus directing the respondents 1 to 3 to restrain the 4th respondent from establishing the "Marana Kinaru and Gaint Wheel"Games at Kuttaithidal Premises at Udumalpet, Thiruppur District without getting proper permission from the 1st respondent by considering the representation of the petitioner herein dated 13.04.2019.

2. According to the petitioner, the 4th respondent is trying to install Giant Wheel at Kuttaithidal Premises at Udumalpet without getting proper permission from the first https://hcservices.ecourts.gov.in/hcservices/

respondent/District Collector. Therefore, the petitioner wants to prevent the installation of such Giant Wheel by the fourth respondent.

3. Today, the matter is taken up for further hearing. Learned Government Advocate, based on instruction, submitted that the first respondent District Collector has already granted permission on 20.04.2019 to the fourth respondent to install such Giant Wheel. It is further seen that the State Government has also issued communication on 23.04.2019 ratifying the permission granted by the District Collector, subject to certain terms and conditions stated therein. Needless to say that the 4th respondent has to strictly comply with the terms and conditions stipulated in the said proceedings of the Government dated 23.04.2019, while operating such Giant Wheel, without giving any room for complaint from any quarters with regard to the safety of the public, while riding the Giant Whees.
