O R D E R

The grievance of the petitioner is that his miscellaneous petition filed before the Judicial Magistrate No.III, Tiruppur in Crl.M.P.No.680 of 2017 not been disposed of by the learned Magistrate in spite of the 1/4

respondent police has filed their counter and pleading completed long back.

The learned Government Advocate (Crl.Side) appearing for the respondent police states that the respondent police has filed counter that the Miscellaneous Petition is not maintainable, the said counter filed as early as 26.09.2017 and it is for the Judicial Magistrate to pass orders in the said Miscellaneous Petition.

The learned counsel appearing for the petitioner states that today the Crl.M.P.No.680 of 2017 is listed before the Judicial Magistrate for orders.

This Court is of the view that if the orders is not passed today, the Judicial Magistrate shall take note of the long pendency of the petition and dispose it on merits including the maintainability of the said petition within a period of one month.

In view of the above, this Criminal Original Petition is disposed of.
