ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police, for the offence under Section 148, 302, 149 r/w 307, 323, 149 r/w 323, 324, 149 r/w 324, 436 IPC and 3(1) of TNPPDAL Act in Cr.No.455 of 2002, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the petitioner along with other accused persons assaulted the family members of one Palanisamy. One person in the family had died while proceeding to the hospital and others were hospitalised. Hence the defacto complainant preferred a complaint before the respondent.

3. The learned counsel appearing for the petitioner submitted that he has not committed any offence as alleged by the prosecution and he has been wrongly implicated in this case and prays for grant of bail.

4. The learned Government Advocate (Crl.Side) submits that there are fifteen (15) previous cases pending against the petitioner herein and hence he strongly opposed this petition.

5. The learned counsel appearing for the petitioner, however, submitted that the petitioner is facing eye problem and therefore, this Court may issue direction to the Central Jail authorities to permit the petitioner to take treatment in the private hospital at his own costs.

6. Considering the fact that there are already fifteen previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. However, on the submission made by the petitioner, this Court granted liberty to the petitioner to file an appropriate application before the jail authorities for taking treatment in the private eye hospital on his own costs.

7. Accordingly, this Criminal Original Petition is dismissed with the above observation.
