CRIME NO.2409/2020 For Petitioner : M/S.M.REBECCA Advocate For Respondent : MR. A.GOPINATH, Govt. Advocate ( Crl. Side) PETITION FOR BAIL 439 Cr.P.C.

ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 10.10.2020 for the alleged offences punishable under Sections 454 and 380 of I.P.C., in Crime No.2409 of 2020, on the file of the respondent police, seek bail.

2. The learned counsel for the petitioners would submit that the petitioners belong to Andhrapradesh and they are in jail for more than 150 days. Now the matter has been taken cognizance in C.C.No.39 of 2020 on the file of the Judicial Magistrate, Arni and trial also commenced and many witnesses have been examined. Since the petitioners/accused are inside the jail, they are not able to defend the case effectively. Hence he prays for granting bail to the petitioners.

4.The learned Government Advocate (Crl.Side) vehemently opposed for grant of bail by stating that all the petitioners belong to Andhrapradesh. It is a case of house broking. Hence he opposed for grant of bail to the petitioners https://hcservices.ecourts.gov.in/hcservices/

5.On perusal of records it is seen that the petitioner had earlier filed a bail application in Crl.O.P.No.5641 of 2021 and this Court by an order dated 26.03.2021 disposed the petition with an direction to the petitioner to call for a report from the Judicial Magistrate, Arani as to the present stage of the trial. Whileso the petitioner has filed the present criminal original petition. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 31/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
