This petition is filed to condone the delay of 295 days in filing the appeal.

Heard Mr.K.Sivakumar, learned counsel for the petitioner and since the first respondent has been set ex parte by the Tribunal and so far as the second respondent is concerned, Mr.S.Arunkumar, learned counsel accepts notice and though he expressed no objection for condonation of delay, stated that the delay caused because of the reasoning attributable to the petitioner. Hence, interest cannot be sought in this period.

That of his submission is taken on record and would be taken care of at the time of disposal of the main appeal.

Having been satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 295 days in filing the appeal is condoned.

Accordingly, the petition stands ordered.
