2. Mr.J.Madanagopal Roa, learned Central Government Standing Counsel takes notice for the respondents.
3. This writ petition is filed seeking for mandamus directing the second respondent herein to send the team of petitioner Federation to attend the ensuing 18th Asian Games to be held at Jakarta, Indonesia based on the petitioner's representation dated 24.01.2018 and to recognize the petitionerFederation as recognized National Sports Federation for the sport of Pencak Silat within a time frame.
4. Heard the learned counsel for the petitioner and the learned Central Government Standing Counsel for the respondents.
5. Insofar as the first relief viz., sending the team of petitioner Federation to attend the ensuing 18th Asian Games to be held at Jakarta, Indonesia, is concerned, the learned counsel for the petitioner fairly submitted that the said relief sought for has become infructuous, since the said Asian Games have already been conducted. However, insofar as the second limb of the prayer seeking the petitioner Federation as recognized National Sports Federation for the sport of Pencak Silat is concerned, it is stated that the representation made by the petitioner for such status on several occasions and the latest of which made on 24.01.2018 have not been considered by the 1st respondent.
6. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner seeking for recognizing their Federation, as it is for the 1st respondent to consider and decide. However, considering the fact that the representations already made by the petitioner was only for including their federation in the Asian Games to be held in the year 2018, it is for the petitioner to make a fresh representation for including petitioner-Federation in the list of 2020 or any subsequent years and if any such representation is made, it is for the 1st respondent to consider and decide the same and pass orders on merits and in accordance with law.
7. With the above observations, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
