Respondent Criminal Original Petition has been filed under Section 439(1)(b) of the Criminal Procedure Code praying to relax the condition that the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders imposed by the learned Special Judge for Trial of Land Grabbing Magistrate-II, Allikulam in Crl.M.P.No.123 of 2018, dated 02.08.2018 in Crime No.254 of 2018.

O R D E R

This Criminal Original Petition has been filed by the petitioner seeking to relax the condition imposed by the trial Court viz., the learned Special Judge for Trial of Land Grabbing Magistrate-II, Allikulam in Crl.M.P.No.123 of 2018, dated 02.08.2018.

2. The learned counsel appearing for the petitioner would submit that the petitioner has to travel many places, since he is a businessman. Thus, the condition imposed by the trial Court is caused hindrance to his business activities which results loss of his business and affects his livelihood. Hence, he filed this petition.

3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Additional Public Prosecutor (Crl.Side) appearing for the State submitted that the petitioner is complying with the conditions regularly imposed by this Court from 06.08.2018 to till date without fail.

5. Considering the nature of the offence committed by the petitioner, the condition already imposed on the petitioner by the trial Court that the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders is modified to the effect that the petitioner shall report before the respondent police on every Monday at 10.30 a.m., until further orders. Except the above modification, the other conditions imposed by the trial Court remains unaltered.

6. Accordingly, this Criminal Original Petition is modified.
