ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 16.12.2020 for the offence under Sections 224 @ 224, 332, 333 of IPC,in Cr.No.1234 of 2020 on the file of the respondent police, seeks bail.
2. This is the second bail application filed before this Court. The case of the prosecution is that the petitioner was facing several cases. On 12.12.2020, the petitioner was taken to Government Hospital, Coimbatore for taking treatment along with Police escort, when the process for taking treatment was being complied with, the petitioner is said to have escaped from custody of the escort Police. Therefore, this case came to be registered.
3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner. 4.The learned Government Advocate (Crl. Side) submitted that the the investigation has been completed and the charge sheet has also been filed in PRC.No.53 of 2021 before the learned Judicial Magistrate https://hcservices.ecourts.gov.in/hcservices/
No.III, Coimbatore. He further submits that there are three previous cases pending as against the petitioner. Hence, he vehemently opposed for grant of bail to the petitioner.
5.Considering the fact that there are three previous cases pending as against the petitioner and earlier petition was dismissed by this Court and there is no change of circumstances, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 30/07/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
