ORDER

The petitioner, who apprehend arrest at the hands of the respondent police pursuant to the Non-bailable warrant issued against the petitioner in C.C.No.189 of 2010 which is pending trial for the offences punishable under Section 406, 470, 294(b), 506(ii) of IPC seeks anticipatory bail.

2. The petitioner originally granted anticipatory bail and he did not appear before the Trial Court and hence, Non-bailable warrant was issued on 13.05.2016 and when the trial Court had initiated action against the sureties, the petitioner filed this petition for anticipatory bail.

3. Learned counsel for the petitioner would submit that the charge sheet has been filed and hence, anticipatory bail may be granted.

4. Learned Government Advocate(Crl.Side) would submit that the warrant is pending from the year 2016 onwards and since the petitioner was already granted anticipatory bail, he is not entitled for second anticipatory bail.

5.Considering the above fact that the petitioner is absconding for a period of more than nine(9) years, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this Criminal Original Petition is dismissed. However, the petitioner is at liberty to appear before the learned Magistrate and file appropriate petition which may be disposed of by the learned Magistrate in accordance with law.
