By order dated 11.04.2018, this Court while disposing of the above said Tr.C.M.P.No.837 of 2017, passed the following order: "In view of the submission and endorsement so made by the learned counsel for the petitioner as well as respondent, the petition in I.D.O.P.No.20 of 2017 pending on the file of the Principal District Judge, Vellore, is ordered to be withdrawn and transferred to the file of the Sub Court, Dharmapuri. The learned Judge, Principal District Judge, Vellore, is directed to transmit all the records pertaining to I.D.O.P.No.20 of 2017 to the file of the Sub Court, Dharmapuri, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the records, the learned Judge, Sub Court, Dharmapuri, is directed to dispose of the case, as expeditiously as possible, in any event not later than six months from the date of receipt of a copy of this order."
2.Pursuant to the above direction, the learned Principal Subordinate Judge, Dharmapuri has sent a letter dated 29.01.2020 to the Registrar General, High Court, Chennai, in which it has been stated that the Principal 1/3
Subordinate Court, Dharmapuri has no jurisdiction to entertain the IDOP case and the case was wrongly transferred.
3.In view of the same, the learned Principal Subordinate Judge, Dharmapuri, is directed to transfer the file pertaining to I.D.O.P.No.20 of 2017 to the Family Court, Dharmapuri. On receipt of the case records, the Family Court Judge, Dharmapuri, is directed to dispose of I.D.O.P.No.20 of 2017 within a period of six months from the date of receipt of the copy of this order.
