O R D E R
Learned counsel for the parties propose that the petition be disposed of in the following agreed terms:
1. The parties will first make an endeavour to resolve the dispute mutually and a window of one month's time may be granted for the same, failing which the matter may go to arbitration for resolution.
2. It is agreed that a sole Arbitrator be appointed to adjudicate the disputes inter se the parties and that the process of adjudication should be governed by the Madras High Court Arbitration Centre. Learned counsel propose Mr.P.Ganesan, a retired Judicial Officer, to be appointed as the Sole Arbitrator. I, thus, appoint Mr.P.Ganesan, a retired Judicial Officer, as the Sole Arbitrator to enter upon reference and adjudicate the disputes between the parties under the aegis of the Madras High Court Arbitration Centre and the parties will be governed by the Rules of the Centre.
3. The arbitration proceedings will commence only after a period of one month if no settlement has been arrived at inter se the parties.
3.The original petition is, accordingly, allowed, leaving the parties to bear their own costs.
