PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to call for the records of the 2nd respondent in Na.Ka.A3/1655/2022 dated 23.01.2023, quash the same and consequently direct the respondents to issue patta in favour of the petitioner for the remaining 5 cents of land in S.No.190/2, Thirukovilur Village, Villupuram District.

ORDER

With the consent of both the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

2. Under Section 13 of the Tamil Nadu Patta Passbook Act, a revision is provided to the District Revenue Officer against the orders passed by any officer of the Registration Department below his rank.

3. The petitioner herein is aggrieved against the order passed by the Revenue Divisional Officer in the present Writ Petition. When a statutory revision is available under the Act, it would be appropriate to grant liberty to the petitioner to prefer a revision.

4. In the light of the above observation, the petitioner is granted liberty to prefer a revision to the District Revenue Officer, within a period of 30 days from the date of receipt of a copy of this order. On 2/4

receipt of the same, the District Revenue Officer shall consider it on its own merits and pass appropriate orders in accordance with law, after giving notice to the persons who may be interested in the subject matter, as expeditiously as possible.

5. With the above liberty, the Writ Petition stands disposed of. No costs.
