Respondent/Petitioner Prayer: The transfer petition is filed under Section 24 of Civil Procedure Code praying to withdraw and transfer the petition, i.e. H.M.O.P.No.1243 of 2017 pending on the file of the learned Principal Judge, Family Court, Coimbatore to the file of Family Court, Chennai.

O R D E R

Earlier, this Court, on 17.11.2017 had directed the matter to be placed before the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras. Accordingly, the parties have appeared before the Mediation Centre, Chennai, resolved their disputes, which was reduced to Joint Memorandum of Compromise dated 23.02.2018 signed by both the parties and their respective counsels.

2. The Memorandum of Compromise is taken on record, which read as follows:

1. The respondent/husband will make a total payment of Rs.21,50,000/- (Rupees Twenty one lakhs and Fifty thousand only) to the petitioner/wife in the following manner:- (i) LIC endowment policy in the name child for the sum of Rs.5,00,000/- excluding GST.

(ii) Rs.3,00,000/- fixed deposit in the name of child.

(iii) and remaining balance of Rs.13,50,000/- demand draft favouring the petitioner/wife.

2. The parties will file petition for Divorce by mutual consent in the Family Court Chennai.

3. The parties will withdraw the respective cases filed in Lower Courts.

4. The respondent/husband will bring cloths, and toys left behind in his house by the petitioner/wife. The above said terms of compromise are recorded.

3. Heard the learned counsels appearing on behalf of the parties.

4. It is also stated that pursuant to the said Joint Memorandum of Compromise, petition for divorce by mutual consent under Section 13B of the Hindu Marriage Act has already been filed.

5. In view of the above settlement arrived at between the parties, the Transfer Civil Miscellaneous Petition is disposed of in terms of the Memorandum of Compromise. The said Memorandum of Compromise shall form part of the order. No costs. Consequently, connected miscellaneous petition is closed.
