ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 417, 376, 294(b) and 506(i) of IPC, in Crime No.9 of 2022, on the file of the respondent police, seek anticipatory bail.

2. It is alleged that the 1st accused/Vijay, promising the de facto complainant to marry her, had sexual relationship with her. On 09.07.202, when the de facto complainant demanded him to marry, the 1st accused is said to have scolded her in filthy language and told her that he will not marry her. When she informed the same to the parents of the 1st accused, they have also scolded her in filthy language and they would not allow the 1st accused/Vijay to marry the de facto complainant. Hence, the complaint in Crime No.9 of 2022 had been filed.

3. The First Information Report indicates that the 1st accused is the main accused in this case. The allegations against the other accused is that they have scolded the de facto complainant in filthy language and made criminal intimidation.

4. Taking note the above facts and circumstances, this Court is of the considered view that the custodial interrogation of the petitioners are not necessary. The act attributed to these petitioners is different from the criminal act against the first accused.

5. Hence, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of seven days from the date of receipt of a copy of this order, before the Learned Judicial Magistrate No.II, Tindivanam, on condition that each of the petitioners shall execute a separate bonds for a sum of Rs.

(c) the petitioners shall report before the Investigating Officer daily at 10.30 a.m., until further orders;

(d) the petitioners shall not tamper with evidence or witness either during investigation or trial;

(e) the petitioners shall not abscond either during investigation or trial;

(f) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; (g) if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
