CORAM
THE HON'BLE MR.JUSTICE B.RAJENDRAN Crl.OP No.22814 of 2015 1.J.Deepan Kumar 2.Murugesan .. Petitioners Vs State represented by Inspector of Police Ammapet Police Station Salem City.
.. Respondent Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C., to direct the respondent police not to harass the petitioners. For Petitioners : Mr.R.Nalliyappan For Respondent : Mr.C.Emalias, Additional Public Prosecutor
ORDER
The petitioners have come up with this petition, seeking a direction to the respondent police not to harass the petitioners under the guise of an enquiry except in a manner known to law.
2. I have heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the respondent.
3. In my considered opinion, no blanket direction as prayed for by the petitioners could be given. If the petitioners are wanted either for enquiry or for interrogation, they can very well be summoned by the respondent police and while doing so, the petitioners shall not be harassed. At the same time, the petitioners should submit themselves to the respondent, if summoned, and shall cooperate for interrogation and enquiry. It is made clear that this order will not shield if the petitioners are involved in any cognizable offence.
