ORDER

The petitioner's father was working as a Noon Meal Organiser and while so he died on 02.11.2001. While so, the petitioner's mother initially made an application for compassionate appointment on 16.07.2001. It can be seen that at that point of time, the petitioner was a minor. Thereafter, the matter was left as such and only in the year 2007, fresh application was made. The said proposal was returned by the District Collector with a query that since the application is not made within a period of three years, how the proposal has been forwarded. Even though the petitioner has been making subsequent applications, there was no consideration and hence the writ petition.

2. Learned counsel for the petitioner would submit that when the application was made in the year 2001 itself within time, the same ought to have been considered by the respondents.

3. I have considered the said submission made by the learned counsel for the petitioner and also the arguments of the learned Government Advocate appearing on behalf of the first respondent and the learned counsel for the second respondent.

4. It can be seen that the petitioner's father died on 02.01.2001. Now, after a period of 23 years, the petitioner is knocking the doors of this Court for compassionate appointment. The purpose of the scheme of compassionate appointment is to provide immediate succour to the family which is in penury. Even though it is stated that the petitioner's mother made an application immediately after the death of the father, for the reasons known to them, the said application has not been pursued. As a matter of fact, the petitioner was a minor at that time. Now, belatedly in the year 2017 once again the petitioner cannot claim appointment for herself and therefore in that view of the matter, the prayer to consider the representation will not yield any fruit to the petitioner and therefore this Court is not in a position to grant the relief as prayed for by the petitioner.

5. Finding no merit, this writ petition is dismissed. There shall be no order as to costs.
