Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Certiorarified Mandamus, calling for the Records of the 1st Respondent pertaining to Lr.No. AE/O and M/T/Tr/F.APTS/A/no. 129/2024 dated 20.03.2024 and quash the same as illegal, arbitrary, violative of principles of natural justice and consequently direct the respondents to detach the extra levy amount form the service connection S.C.No. 364-019-710 of the petitioner and restore the electricity supply in the same and for consequential orders. 1/5

O R D E R

The proceedings dated 20.03.2024, issued by the Assistant Engineer, disconnecting the electricity service connection of the petitioner's premises is under challenge in the present writ petition.

2. The petitioner has misused the electricity service connection provided in his premises and accordingly, additional charges are levied on the petitioner to pay a sum of Rs.2,49,436/-. Since the petitioner has not paid the additional charges, the electricity service connection was disconnected.

3. The learned counsel for the petitioner would submit that the petitioner is having children and without electricity service connection his family is suffering, especially during summer season. The petitioner has further given an undertaking that he will settle the entire dues along with the consumption charges in four equal instalments without committing any 2/5

default.

4. In view of the said undertaking, the following orders are passed: (i) The petitioner is directed to pay the first instalment immediately and on such payment, the respondents are directed to restore the electricity service connection in the premises of the writ petitioner. (ii) The balance three instalments are directed to be settled on or before 15th day of every English calender month. (iii) In the event of default in paying the instalments by the petitioner, the respondents shall disconnect the electricity service connection of the petitioner's premises.

(iv) The petitioner shall pay the consumption charges as per the usage.

5.With these directions, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. (sha) 23.04.2024 Index : Yes Speaking Order To 3/5
