For Petitioner : M/S.A.RAMESH Advocate For Respondent : M/S.A.DAMODARAN, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, apprehends arrest at the hands of the respondent police for the offence punishable under Section 399 of I.P.C, in Crime No.157 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were alleged to commit dacoity. Hence, the Law Enforcing Agency registered a case against the petitioners.

3. It is seen from the records that this is the fourth bail petition filed by the petitioner. The earlier petitions filed by the petitioners in Crl.O.P.No.19949 and Crl.O.P.No.24192 of 2021 and Crl.O.P.No. 5627 of 2022 were dismissed on 26.10.2021, 13.12.2021 and 10.03.2022 respectively.

He would further submit that the petitioners have been falsely implicated in this case and he is ready and willing to abide by any stringent condition that may be imposed on him.

4. The learned Additional Public Prosecutor would submit that there is no change of circumstances after the previous order was passed on merits. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the bad antecedents of the petitioner, this Court had dismissed the earlier petitions filed by the petitioner and that there is no change of circumstances. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
