This Criminal Original Petition has been filed to direct the second respondent to register the complaint of the petitioner dated 24.07.2015 and investigate the same in accordance with law.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.

3. It is the case of the petitioner that some local persons with political patronage are collecting money from public, for performing Kumbabishekam and Annadhanam at Sennimalai Murugan Temple. In this connection, enquiry is being conducted by the Executive Officer of Arulmighu Subramania Swamy Temple, Sennimalai, as it could be seen from the proceedings of the Executive Officer dated 30.09.2015 https://hcservices.ecourts.gov.in/hcservices/

wherein, he has issued summons to one P.Gopalakrishnan asking him to produce all the records. Under Rule5(A) of Collection of Income and Incurring of Expenditure Rules 1961, the Competent Authority will have the power to conduct enquiry, if any unauthorised persons are collecting money in the name of the temple. This is exactly what the Executive Officer has now undertaken.

4. If the Executive Officer finds that there is unauthorised collection of money, he shall forward the complaint to the respondent Police, who is directed to take action on the said complaint in accordance with law.

With the above direction, this Criminal Original Petition is closed.
