ORDER

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379, 430 of IPC in Crime

No.326 of 2024, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that he smuggled one unit of river sand without any valid permit or license, using a tipper lorry. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner had already been enlarged on anticipatory bail by this Court in Crl.O.P.No.16317 of 2024 vide order dated 12.07.2024; however he was not in a position to comply with the same. Hence, he prays for the grant anticipatory bail to the petitioner. 4.At this juncture, the learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner has six previous cases of a similar nature. However, the said fact was not brought to the notice of the earlier Bench. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. Heard the learned counsel on either side and perused the materials available on record.

6. Taking into consideration the pendency of previous cases against the petitioner, this Court is of the firm view that he has misused the liberty granted

by this Court. Hence, he does not deserve the grant of anticipatory bail. Accordingly, this Criminal Original petition is dismissed. 07-04-2026 MPA To 1.The Inspector of Police Ambur Taluk Police Station.
