Mr.G.Krishna Kumar Order The petitioner apprehends arrest for the alleged offence under Sections 420, 464, 465, 467, 468, 471, 120B of IPC in corresponding sections are 318(4), 335, 336(2), 338, 336(3), 340(2), 61(2) of BNS in Crime No.74 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner has created fake eath certificate and also forged legal heir certificate and thereby executed settlement deed. According to the prosecution, the allegation against the A1 and A2 have created fake life certificate with the help of this petitioner. Hence, this case.

3. The learned counsel for the petitioner submitted that FIR was registered on 31.12.2025 and that the petitioner has been charged under various sections. He further submitted that the petitioner was innocent and that he has been falsely implicated in this case and he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. At this juncture, the learned counsel for the Intervenor submitted that the property originally belongs to one Kaliyappa thambiran. With the help of this petitioner, A1 and A2 have obtained and forged legal heir certificate as the said Kaliyapa Thambiran has got one legal heir by name Narayana Murthy and dealt with the family property. Based upon the fabricated Power of Attorney executed by A2 and in furtherance thereof, A1 sold property worth about Rs.One crore.

5. At this juncture, the learned Government Advocate (Crl.Side) submitted that the money is yet to be recovered and unless the custody of the

petitioner is taken, the involvement of the other accused cannot be identified. Hence, he opposed to grant anticipatory bail to the petitioner.

6. I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.

From the submission made by the learned Government Advocate (Criminal Side), it is seen that the allegation against the petitioner is that he has created fake life certificate and legal heir certificate and thereof have suppressed existence of the legal heir of Kaliyappa thambiran. In furtherance thereof the petitioner has also dealt with property worth about Rs.1 crore. The submission of the learned Govt Advocate (Crl.Side) that the custody of the petitioner is required so as to identify the layering of the money and involvement of other accused cannot be found faulted. Therefore, this Court is of the firm view that the petitioner does not deserve anticipatory bail.

8. Accordingly, this Criminal Original Petition is dismissed and the connected miscellaneous petition is closed.
