ORDER

This Writ Petition has been filed to call for the records of the second respondent vide online Notification i.e., Advt.No.1 of 2024, dated 09.03.2024 and quash the same and direct the 2nd respondent to issue fresh notification, granting 75% to the PAPs upto 2022 and 25% to the PAPs from 2023 onwards.

2. Heard Mr.R.Surendran, learned Additional Government Pleader appearing for the first respondent and Mr.N.Nithyanandam, learned counsel appearing for the second respondent.

The case of the petitioner is that his father owned agricultural land in Valayamadevi, Keezhpathi Village, Bhuvanagiri Taluk, which was acquired by the second respondent in the year 2006 for mining purposes. An award in Award No.23 of 2009 dated 05.10.2009 was passed and compensation was paid, and possession of the land was taken by the second respondent. The said land was the primary source of livelihood for the petitioner's family and therefore the petitioner, being a legal heir, is entitled to employment under the

Rehabilitation and Resettlement Scheme as a Project Affected Person (PAP) in terms of the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The second respondent issued Advertisement No.1 of 2024 dated 09.03.2024 inviting applications from Project Affected Persons for training by allocating 50% of slots to recent awardees and persons issued notices under Section 3(1) and 3(2) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997, which is arbitrary and prejudicial to earlier awardees like the petitioner who have been awaiting employment for several years. Hence, aggrieved by the said impugned notification, the petitioner has filed the present Writ Petition.

4. The learned counsel for the petitioner submitted that this Court may grant liberty to the petitioner to file a separate writ petition claiming employment rights on the basis of the scheme under which the petitioner's land was acquired.

Considering the facts and circumstances of the case and the submission made by the learned counsel for the petitioner seeking liberty to file a separate writ petition claiming employment rights on the basis of the scheme under which the petitioner's land was acquired, this Court is inclined to grant such liberty.

6. Accordingly, this Writ Petition stands disposed of granting liberty to the petitioner to file a separate writ petition claiming employment rights on the basis of the scheme under which the petitioner's land was acquired, in accordance with law. No Costs. Consequently, connected miscellaneous petitions are closed.
