Respondent Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to release the registered sale deed dated 26.04.2021 registered as document No.2270 of 2021 in favour of the petitioner.

ORDER

This writ petition is filed for direction directing the respondent to release the registered sale deed dated 26.04.2021 registered as document No.2270 of 2021 in favour of the petitioner.

2. Heard, M/s.Dhalapathy Vignesh Kumar, the learned counsel for the petitioner and Mr.Yogesh Kannadasan, Special Government Pleader appearing for the respondent.

3. The petitioner purchased the property situated at Plot No.4 Sri Lakshmi Nagar, Pidarithangal Village, Poonamallee, Chennai 600 056, in the CMDA approved layout vide PPD/LO No.64/2006 comprised in old S.Nos.7/1A and 8/2 and New S.Nos.7/5B and 8/1C2 of Pidarithangal Village, Thiruvallur District measuring an extent of 1040 sq.ft. and building measuring about 900 sq.ft. in the ground floor and 800 sq.ft. in the first floor totally measuring about 1700 sq.ft. of built up area, by a registered sale deed dated 26.04.2021, registered as document No.2270 of 2021 before the respondent herein. https://hcservices.ecourts.gov.in/hcservices/

4. After assigning document No.2270 of 2021, the respondent refused to release the document for the reason that the petitioner has not valued the property properly.

5. Considering the same, the respondent is directed to release the document which was registered vide document No.2270 of 2021 dated 26.04.2021, if not referred under Sections 33-A and 47-A of the Tamilnadu Stamp Manual. If any proceedings initiated under Sections 33-A and 47-A of the Tamilnadu Stamp Manual, the respondent is directed to issue the proceedings forthwith to the petitioner.

6. With the above directions, this writ petition is disposed of. No order as to costs.
