2.The other respondents have remained absent before the Trial Court. Hence, notice to them is dispensed with in terms of Sub-Rule 4, Rule 14 of Order 41 of C.P.C, since the present proceedings are only incidental to an appeal.

3.Accepting the reasons assigned in the affidavit filed in support of the petition, this petition is ordered, the delay in filing the appeal is condoned.
