On representation of the counsel for both sides this case is taken up for settlement before the Lok Adalat. Both the parties are present. Mr.K.Varadhakamaraj, learned counsel for the appellant and Mr.D.Bhaskar, learned counsel for the 2nd respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

It is the claimant's appeal. Seeking compensation for the injury caused to her in the accident, she sought for compensation of Rs.8,00,000/-.

2. The Tribunal, after arriving at the total compensation of Rs.8,71,911/-, has awarded a sum of Rs.8,00,000/- together with interest at 7.5% per annum from the date of petition till the date of deposit and costs as compensation. The same has been withdrawn. Seeking enhancement by a sum of Rs.3,00,000/- the present appeal has been filed.

3. After due deliberation and consultation, the parties have arrived at a compromise and the claimant has agreed to receive a sum of Rs.1,75,000/- (Rupees One Lakhs Seventy Five Thousand only) in full quit.

4. The 2nd respondent/Insurance company is directed to deposit a sum of Rs.1,75,000/- (Rupees One Lakhs Seventy Five Thousand only) within a period of eight weeks from the date of receipt of a copy of this order. Award is passed accordingly.

5. The Tribunal is directed to transfer the amount through RTGS/NEFT to the claimant concerned on proper identification in accordance with the terms of the Award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. Prema Counsel for the Appellant The United India Insurance Co.
