Writ petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus, to direct the respondent to refund the fee collected from the petitioner for the 2nd year BHMS course on 22.08.2012 and amounting to Rs.1,19,800 together with interest at 18% per annum from the date of the payment till the date of refund.

O R D E R

The petitioner seeks for a direction to the respondent to refund the fees collected from him for the second year BHMS course by contending that the petitioner has not attended the second year of the said course and on the other hand, left the respondent college after completion of the first year itself.

2. It is the case of the petitioner that the respondent collected the second year fees also from the petitioner at the time of admission.

3. In this writ petition, though notice was ordered to the respondent as early as on 22.02.2013 and served on him, the respondent has not chosen to appear before this Court, when the matter is listed today. The name of the respondent is printed in the cause list. None appears for the respondent. https://hcservices.ecourts.gov.in/hcservices/

4. The learned counsel for the petitioner submitted that the repeated representation sent by the petitioner seeking for refund has not been considered by the respondent so for. The respondent has also not come forward to appear before this Court and explain as to why the petitioner's request has not been considered so far. Therefore, without expressing any view on the claim made by the petitioner, I only direct the respondent to consider the request of the petitioner for refund and pass appropriate orders on the same on merits and in accordance with law, within a period of three weeks from the date of receipt of a copy of this order. No costs.
