Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the third respondent herein, viz., Revenue Divisional Officer, Sriperumbudur Taluk, Kanchipuram District, to take action and pass necessary orders, concerning the property situated at No.39, Mambakkam Village, Patta No.426, Survey No.94/3, measuring an extent of 2 acre and 48 cents, based on the representation dated 04.04.2022 given by the petitioner. ORDER

The prayer made in this writ petition is to issue a Writ of Mandamus directing the third respondent herein, viz., Revenue Divisional Officer, Sriperumbudur Taluk, Kanchipuram District, to take action and pass necessary orders, based on the representation dated 04.04.2022 given by the petitioner. 2.According to the petitioner, he is a senior citizen aged 97 years and is in continuous possession of his ancestral property situated at No.39, Mambakkam Village, Patta No.426, Survey No.94/3, measuring to an extent of 2 acre and 48 cents. While so, without any notice, the revenue officials issued a joint patta both in the name of the petitioner's father viz., Raghava Reddy as well as in the names of one Ponnusamy, Kannayira Reddy and Subba Reddy, who do not have any nexus with the subject properties of the petitioner.

After coming to know about the same, in the year 2006, the petitioner has been repeatedly approaching the revenue officials, requesting to conduct appropriate enquiry and rectify the defects made in the document pertaining to the subject properties. However, till date, no action was taken on the same. Therefore, this writ petition.

3.Heard both sides and perused the documents enclosed in the typed set of papers.

4.Considering the limited relief sought in this writ petition, this court, without going into the merits of the case, directs the third respondent to consider the representation of the petitioner dated 04.04.2022 and pass appropriate orders, on merits and in accordance with law, after providing an opportunity of hearing to the petitioner as well as any other interested parties, within a period of six weeks from the date of receipt of a copy of this order.

5.Accordingly, this Writ Petition stands disposed of. No costs.
