It is represented by the learned counsel for the appellant that he came to know that the appellant died long ago and he could not contact his legal heirs inspite of his repeated attempt. It is stated that the information regarding the death of the appellant is also given by the neighbours of the appellant. Therefore, the learned counsel for the appellant submits that as he has no information from any of the legal heirs of the appellant, the appeal may be dismissed as abated. Accordingly, the appeal is dismissed as abated. No costs.
