The learned counsel for the appellant seeks permission of this Court to withdraw the appeal as the dispute between the parties is settled out of Court and he has also made an endorsement to that effect.

In view of the submission made by the learned counsel for the appellant and the endorsement so made, this Second Appeal is dismissed as withdrawn. Consequently, connected Miscellaneous Petition is also closed. No costs.
