Prayer: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to call for the records relating to the proceedings nil dated 09.04.2024 summon issued by the 2nd respondent, Nallur Police Station, Tiruppur District and quash the same. The petitioner herein who summoned by the Inspector of Police, Nallur to appear for enquiry pursuant to the complaint give by one Senthil Kumar is before this Court, challenging the summon issued under Section 91 of Cr.P.C.
2. According to the learned counsel appearing for the petitioner , the very same complainant earlier gave a complaint to CCB,Tiruppur and after enquiry, complaint was closed. This has been reported to the High Court when the petitioner moved to quash petition in Crl.OP.No.5195 of 2024. The order of this Court in the said criminal original petition dated 05.03.2024 is also enclosed for perusal.
3. The learned Government Advocate (Crl.Side) appearing for the respondent police states that the summon has been issued by the local police pursuant to the complaint sent by post to the Commissioner of Police directed to the Nallur Police Station, for investigation. If CCB has already investigated the complaint and closed it and the same will be taken note of and appropriate proceedings will be issued. 2/4

In the light of the above fact, this Criminal Original Petition is disposed of directing the petitioner herein to appear before the second respondent police/ The Inspector of Police, Nallur Police Station, Tirrupur District on 15.05.2024 and produced all the documents including the order passed by this Court in Crl.OP.No.5195 of 2024 dated 05.03.2024. Based on the documents produced, the second respondent police shall take appropriate decision. Consequently, the connected miscellaneous petition is closed.
