2016-12-01Honourable Mr Justice T.Raja2 pages

C.M.P.No.18157 of 2016 in C.M.A.SR.No.77706 of 2016 T.RAJA, J This petition has been filed to condone the delay of 462 days in filing the above appeal.

2.The Managing Director of Tamil Nadu State Transport Corporation, Villupuram, has challenged the impugned award dated 16.09.2014 in M.C.O.P.No.4147 of 2009 passed by the Motor Accident Claims Tribunal (II Judge, Court of Small Causes) Chennai, in awarding a sum of Rs.5,12,100/- with interest at 7.5% from the date of petition till realisation for the multiple injuries sustained by the injured/respondent. 3.Although, the award was passed on 16.09.2014, the Transport Corporation has not preferred any appeal for a long time. Consequently, a huge and unexplained delay of 462 days had occurred. The affidavit filed in support of the petition to condone the delay simply says that the application for certified copy of the order and decretal order was filed on 31.03.2015 and the copy was made on 27.10.2015 and after receiving the same on 28.10.2015, they again kept quiet, without even taking any steps to file an appeal.

4.Therefore, this Court is not able to find any sufficient cause in entertaining this petition, since no where sufficient cause has been mentioned T.RAJA, J

kal in the affidavit filed in support of the delay petition. Accordingly, this petition fails and the same is dismissed. Consequently, CMA No.SR77706/2016 stands rejected.
