..Respondent(s) PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of certiorarified mandamus calling for the records in respect of the impugned order No.A.12011/ 150/ 2025/ DP and AR (exam (dated 04.12.2025 passed by the 2nd respondents and quash the same and direct the 1st respondent to consider and issue the offer of an appointment order in terms of the vacancy very much available.

ORDER

The petition has been filed to quash the impugned order No.A.12011/

150/ 2025/ DP and AR exam dated 04.12.2025 passed by the second respondent and direct the first respondent to consider and issue the offer of an appointment order in terms of the vacancy very much available.

It is the case of the petitioner that the petitioner has appeared for Direct Recruitment to the post of Lower Division Clerk and Store Keeper Grade III and secured 47.75 marks falling short of the cut-off mark of 48 for the MBC Category. It is the case of the petitioner that the current waiting list for the MBC Category contains only one candidate, whereas, there are 13 vacancies available for the post of LDC/StoreKeeper under the MBC Category. Therefore, the petitioner made a representation to the second respondent for inclusion of 12 additional candidates beyond the provisional waiting list to fill up the vacancies. Since there was no response till date, the petitioner is before this Court.

3. Heard the learned counsel on either side and perused the materials available on record.

4. The petitioner is seeking a direction to offer an appointment to him in terms of the vacancy available. The petitioner had applied for the post of the Lower Division Clerk and Store Keeper Grade III under MBC Category. The petitioner would submit that he has secured 47.75 marks which even according to him is short of cut-off mark of 48. It is not the case of the petitioner that the

cut-off mark has been further reduced, thereby, giving him a right to seek appointment in the vacant category. The impugned order clearly states that the mark is way below the cut off mark and that apart, the petitioner's name does not feature even in the waiting list. That apart, since the fresh notification of recruitment has been issued vide Notification No.A-34012/3/E-5/PEA/2025 dated 17.11.2025, the merit list which has been prepared in 2023 ceases to be operative. Therefore, the petitioner's request cannot be granted and I see no infirmity in the impugned order.
