ORDER

(Order of the Court was made by M.M.SUNDRESH, J.) Seeking to forbear respondents 1 and 2 from proceeding with the further action pursuant to the sale notice CO/REC/NPA/2020 dated 19.06.2020 till the disposal of S.A.No.244/2020 on the file of Debts Recovery Tribunal at Coimbatore, the present writ petition has been filed.

2.The grievance of the petitioner is that pending the application filed in S.A.No.244 of 2020, the auction is proposed to be held on 03.09.2020.

3.In such view of the matter, we direct the Debts Recovery Tribunal, Coimbatore to take up the pending application seeking interim order and decide the same on 01.09.2020. If no such application is filed by the petitioner, liberty is given to him to file such an application. If the same is filed on or before 27.08.2020, it has to be numbered and taken up for hearing on 01.09.2020.

4.With the above direction, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
