O R D E R

The petitioner who was remanded to judicial custody on 09.05.2021 for the offence under Section 174 of Cr.P.C. and later altered to under Sections 120(b), 323, 294(b), 302 of IPC in Cr.No.1494 of 2020 on the file of the respondent police, seeks bail.

2.It is the case of the prosecution that A1 in the case borrowed money from deceased Premkumar. When the deceased and his family members demanded money, A1 and the other accused conspired together, took the deceased in an Auto and committed murder of the deceased and thrown the body of the deceased into a Well. The petitioner is arrayed as A3 in the case. 3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and that he has been falsely implicated in this case. He further submitted that there was money dispute inbetween A1 and the deceased and further submitted that A1 was the owner of the Auto and the petitioner is only a passenger in the Auto.

4.The learned Government Advocate (Crl. Side) submitted that the petitioner and the other accused conspired together and committed murder of the deceased Premkumar and further submitted that after committing murder of the deceased in this crime number all the accused joined together and also committed murder of the deceased's mother and further submitted that investigation is pending.

5.Considering the facts and circumstances of the case and the nature of the allegations levelled against the petitioner, I am not inclined to grant bail to the petitioner. 6.Accordingly, the criminal original petition is dismissed. -sd/- 14/06/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
